The applicant requests Variance and Design Review approvals to construct a 2,172-square-foot, multistory addition with a 137-sqaure-foot covered porch to a primary residential structure (single-family residence) on a developed lot located within an unincorporated area of Mill Valley (the community of Tamalpais Valley). Per the codified Tamalpais Planning Area Community Standards, the 2,172 square feet of proposed development would result in a total adjusted floor area ratio of 31 percent on the 14,400-square-foot lot (excluding the 137-sqaure-foot covered porch). The proposed addition would reach a maximum height of 35 feet above grade and the exterior walls would appear to have the following setbacks: 12 feet, 11 inches to the southern front property line; 95 feet, 7 inches to the eastern side property line; 28 feet, 1 inch to the western side property line; and 24 feet, 9 inches to the northern rear property line. The proposed porch, attached to the multistory addition, would reach a maximum height of 19 feet, 7 inches. The exterior columns appear to have the following setbacks: 9 feet, 6 inches from the southern front property line; 117 feet, 8 inches from the eastern side property line; 49 feet, 9 inches from the western side property line; and 53 feet, 3 inches from the northern rear property line.

Various site improvements would also be entailed in the proposed development, such as other structural improvements, including an attached deck and stairs that meet objective development standards; landscaping and aesthetic enhancements, featuring the installation of a variety of ornamental plantings; and grading activities that would prepare the site for construction, requiring 3 cubic yards of fill and cut, respectively. 

Variance approval is required pursuant to Section 22.54.020 of the Marin County Development Code because the proposed multistory addition would not conform to the minimum required 25- foot front yard setback established by the governing R1-B1 zoning district (Section 22.14.050(B), Table 2-11) or the 30 percent maximum floor area ratio (FAR) prescribed by the codified Tamalpais Planning Area Community Standards (Section 22.30.060(A)), and the covered porch would not conform to the 6-foot allowed projection into the minimum required front yard setback for covered porches (Section 22.20.090(E)(1), Table 3-1). 

Design Review approval is required pursuant to Sections 22.42.020(B) and 22.54.045(G) of the Marin County Development Code because the proposed multistory addition would result in a primary residential structure in a Conventional zoning district that exceeds a total floor area of 3,500 square feet and has heights greater than 30 feet above grade but not exceeding 35 feet above grade.
