Project Description
The applicant requests Design Review approval to construct a new pool with an integrated retaining wall and Tree Removal Permit approval to remove three protected trees and one heritage tree on a developed lot in San Anselmo. The proposed development would not result in an increase of the existing floor area ratio of 11 percent on the 41,160 square foot lot. It appears the proposed pool with an integrated retaining wall would reach a maximum height of 14 feet, 1 ½ inches above surrounding grade and the exterior walls would have the following setbacks: 97 feet, 1 1/8 from the northern front property line; 21 feet, 3 ½ inches from the western side property line; 26 feet, 8 1/16 inches from the eastern side property line; 281 feet, 4 9/16 inches from the southern rear property line. It appears the applicant would remove a six-inch protected Coast Live Oak tree, an eight-inch protected Coast Live Oak tree, a 15-inch protected Coast Live Oak tree, and a 30-inch heritage Coast Live Oak tree. A new patio with a railing would also be included in the proposed development.
Design Review approval is required pursuant to Marin County Code Section 22.20.052 because the height of the proposed pool with an integrated retaining wall would exceed the retaining wall standards. Additionally, Tree Removal Permit is required pursuant to Marin County Code Section 22.62.020 because more than two protected trees are proposed to be removed in a 12-month period and one heritage tree is also proposed to be removed.
